How to Buy Off-Market Property in Victoria, Step by Step
The BuyerHQ Research Team · 1 October 2026 · 7 min read
Finding an off-market home is only half the job. Buying it well means running the same checks as a public sale, usually on a shorter clock and with less information handed to you. This is the sequence that works in Victoria.
## 1. Get ready before anything appears
Quiet sales move quickly and vendors favour certainty. Have written finance pre-approval, your deposit available, and a conveyancer who can turn around a contract review within a day or two. The [readiness quiz](/guide/quiz) shows what is still missing, and the [borrowing](/tools/borrowing) and [stamp duty](/tools/stamp-duty) tools help you set a realistic ceiling.
## 2. Define a clear brief
Suburbs, property type, bedrooms, land, must-haves and a budget range. A specific brief is what agents and matching platforms act on. Set yours in your [buyer brief](/brief) so matches can reach you.
## 3. Confirm the sale is genuine
Ask two questions straight away: does the agent hold a signed authority to sell, and is a Section 32 vendor statement available now? If the answer to either is no, you are looking at a possibility, not a property for sale.
## 4. Inspect and research
Inspect in person, ideally twice. Pull recent comparable sales for the street and suburb yourself rather than relying only on the agent's selection. Use the [inspection checklist](/tools/inspection-checklist) and track the property in your [tracker](/tracker) so notes and documents stay in one place.
## 5. Read the Section 32 with your conveyancer
Look for easements, planning overlays, building permits, owners corporation details and outstanding notices. Check zoning and overlays on the free VicPlan map as well.
## 6. Order building and pest inspections
A private sale is not a reason to skip them. If time is short, make your offer subject to a satisfactory inspection.
## 7. Make a written offer
Off-market sales in Victoria are private treaty sales. Put your offer in writing with price, deposit, settlement length and any conditions such as finance or inspection. Terms matter: a vendor may prefer a cleaner offer or a settlement date that suits them over a slightly higher price.
## 8. Understand your cooling-off rights
For most private sales of residential property in Victoria, buyers have a three business day cooling-off period after signing, with a penalty if they withdraw. There are exceptions, including sales within three business days either side of a publicised auction and buyers who received independent legal advice before signing. Confirm with your conveyancer before you sign.
## 9. Sign, pay the deposit and settle
Once the contract is signed and the deposit paid, your conveyancer manages the path to settlement. Book a pre-settlement inspection in the final week.
